Notice of Passing of a New Zoning By-Law

TAKE NOTICE that the Council of the Corporation of the Municipality of Charlton and Dack passed By-law No. 176 on May 13, 2013, under Section 34 of the Planning Act, RSO 1990.

PURPOSE AND EFFECT: The Municipality of Charlton and Dack passed a new zoning by-law to regulate the use of land, buildings and structures on all properties in the Municipality.  The by-law is required to implement the Official Plan for the Central Timiskaming Planning Area as it applies to the Municipality of Charlton and Dack.  The new By-law sets out comprehensive zoning standards such as minimum lot area, frontage, setbacks from property lines, building height, parking, the regulation of accessory uses, home based businesses, separation distances from conflicting land uses and other performance requirements. The new by-law sets out definitions for all permitted land uses and establishes zones for various types of residential, commercial, industrial, institutional, open space and agricultural uses. A zone map (schedule) illustrates the application of the zones to properties throughout the Municipality.  

Appeal - The last date for filing a notice of appeal of the by-law is June 6, 2013. Any such appeal must be filed with the clerk of the municipality and must set out the reasons for the appeal and must be accompanied by the fee required by the Ontario Municipal Board. Only individuals, corporations and public bodies may appeal a zoning by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.  No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person of public body made oral submissions at the public meeting or written submissions to the Council of the Municipality of Charlton and Dack or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
