The Municipality of Charlton and Dack belong to the Temiskaming Municipal Services Association (TMSA). The TMSA enforces the Ontario Building Code & Act which are regulations that are set in place by the Province of Ontario. Under the requirements of the Building Code Act, municipalities are responsible for the enforcement of the Act. The Building Code sets minimum standards, which ensures public safety and uniformity in the construction industry.

Other things to consider

  • In addition to the building permit all construction  must comply with the Municipal Official Plan and Zoning.
  • A residential unit must have septic approval from the Timiskaming Health Unit.
  • Construction of any dwelling  on an unmaintained municipal road will not be permitted.
  • Access to a provincial highway requires MTO approval.

Temiskaming Municipal Services Association (TMSA)

The Building Department for our municipality is managed through a partnership with the Temiskaming Municipal Services Association (TMSA). To ensure the highest level of trust and safety in our community, the Chief Building Official (CBO) operates under a formal Code of Conduct.

Our Commitment to You

When you apply for a building permit or request an inspection, you can expect our building services to be delivered based on these four core values:

· Fairness: Every application is treated equally. We apply the rules of the Ontario Building Code consistently, regardless of who the builder or homeowner is.

· Independence: The CBO makes decisions based strictly on the law and technical safety standards. These decisions are made independently of any outside or political influence.

· Integrity: Our staff acts with honesty and professionalism. We aim to protect the safety of the public and the integrity of the buildings in our region.

· Objectivity: Decisions are based on facts and the requirements of the Building Code Act.

A Unique Partnership

While the CBO is an employee of the TMSA (a not-for-profit association), they are directly appointed by our Municipal Council. This means they are legally responsible to our municipality to ensure all construction meets provincial safety standards.

Accountability

We take all concerns regarding professional conduct seriously. The Building Code Act requires a formal process for handling complaints about the conduct of building officials:

· If a member of the public believes there has been a breach of this Code, they should contact the Chief Administrative Officer (CAO) of the municipality where the work is located.

· The CAO will then bring the matter to the TMSA Board.

· The TMSA Board will formally review the matter and take any necessary action to ensure standards are maintained.

Building codes exist to protect the health, safety, and accessibility of the places where we live, work, and play. This Code of Conduct ensures that those safety rules are enforced fairly and professionally across all 21 member municipalities in our region.
